Unfrazzled, LLC Terms (Updated 7/30/24)

  • Terms apply to all interactions with Unfrazzled, LLC and its owners/presenters, including discussions, articles, participating in trainings, workshops, one-on-one sessions, presentations, recordings, Unfrazzled University, or other programs ("Interactions").
  • Participants/purchasers and anyone interacting with Unfrazzled, LLC must be 18 years of age or older.
  • All information/materials provided/shown/discussed and all intellectual property (together "Info") is owned solely by Unfrazzled, LLC. Interactions provide each participant only rights to personal use of Info. Participants shall not copy, change, publish, reverse engineer, or share Info, or help anyone else do so. Unfrazzled, LLC may change or remove Info/Interactions at any time.
  • Paid one-on-one sessions are confidential, even if paid for by participant's employer or another third party.
  • Info and Interactions are for participant educational and informational purposes only and are never legal, financial, tax, medical, health, or any other kind of professional advice. No attorney/client relationship is formed with purchaser/participants.
  • Unfrazzled, LLC can’t guarantee any particular results - it’s up to purchaser/participants to carefully consider and apply information and put in the work to obtain desired results, seeking additional advice or expertise where necessary. Purchaser/participants accept personal responsibility for their actions using any Info provided, because success is ultimately up to each individual's efforts and many personal and other factors outside of Unfrazzled, LLC's awareness and control.
  • UNFRAZZLED, LLC MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, ABOUT ITS PERFORMANCE, INTERACTIONS, OR INFO; ALL EXPRESS OR IMPLIED WARRANTIES ARE DISCLAIMED INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. ALL INTERACTIONS/INFO ARE PROVIDED “AS IS” WITHOUT ANY WARRANTIES OF ANY KIND, AND POTENTIAL WARRANTIES ARE DISCLAIMED.
  • Purchasers/participants shall not hold Unfrazzled, LLC or its owners/presenters liable for any harm or loss resulting from Unfrazzled, LLC Info or Interactions whether arising from errors/inaccuracies or otherwise, purchaser/participants also expressly wave all claims against Unfrazzled, LLC and its owners/presenters arising from any Info/Interactions, and purchaser/participant shall also indemnify and defend Unfrazzled LLC and its owners/presenters from any harm arising from purchaser's/participants’ use/misuse of any Info/Interactions and from their breach of these terms (including attorneys fees). Purchaser/participants attempting to bring a claim related to Unfrazzled, LLC Info/Interactions/related to these terms must do so only through arbitration (no class arbitration, individual only) in Rhode Island and pay all costs associated with the arbitration. 
  • Before taking any further action, Purchasers/participants shall first raise and use best efforts to resolve any issues/questions directly with Unfrazzled, LLC as soon as possible.
  • No purchases/Interactions create any joint venture/partnership/employment/agency relationship with Unfrazzled, LLC/owners/presenters.
  • Once purchased, Interactions are not refundable. Interactions may not be rescheduled if purchaser/participant no-shows or cancels less than two business days in advance, otherwise Unfrazzled, LLC may allow purchaser/participant to reschedule, subject to Unfrazzled, LLC's availability and discretion. If Unfrazzled, LLC reschedules an Interaction, purchaser/participant will be offered an alternate time (or Unfrazzled, LLC may choose to refund in its sole discretion).
  • Interactions must generally be paid for in advance. However, if Unfrazzled, LLC allows Interactions before payment, purchaser/participant shall pay amounts due for Interactions no later than two weeks after Interactions are provided and shall not withhold or refuse to pay full amount due for any reason.
  • Purchaser/participants’ only remedy for any issue, potential claim, nondelivery of Interactions/Info, or breach of terms, is to stop using Info/Interactions, and a full/partial refund of the applicable cost if Unfrazzled, LLC chooses to refund in its sole discretion.
  • If purchaser/participant breach terms, Unfrazzled, LLC may in its sole discretion cancel Interactions and/or withdraw/withhold Info without refunding, at its option (in addition to other applicable remedies).
  • Unfrazzled, LLC may in its sole discretion, at any time, cancel, withhold, and/or withdraw any Interactions or Info, for any or no reason, and instead give a refund for the undelivered portion of Interactions/Info.
  • Any refunds given or offered by Unfrazzled, LLC will, at Unfrazzled, LLC's option, be reduced by the payment/processing fees charged by Unfrazzled, LLC's current payment processor.
  • If purchaser and participants are different, both/all agree to terms. Purchaser shall notify its participants of terms before delivery of Info/Interactions by providing a link to these terms, and purchaser is liable for any failure to do so.
  • These terms supersede other communications/discussions/documents re: Info and Interactions, and any changes to these terms between purchaser/participant and Unfrazzled, LLC must be in writing.
  • Unfrazzled, LLC may change terms from time to time in its sole discretion, please revisit terms before purchasing/using any new Info/Interactions.
  • Choice of law and venue: Rhode Island.
  • Remaining terms survive any invalid/unenforceable terms.
